Terms of Use

1. Agreement

These Terms are an agreement between you and IWE Techs, Rajkot, Gujarat, India ("we", "us"), the operator of Picoza AI (the "app"). By using the app you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the app. If you downloaded the app from the Apple App Store or Google Play, their terms also apply to your use of their store.

2. Who can use the app

You must be at least 13 years old. If you are under 18, you may use the app only with the permission of a parent or guardian, who agrees to these Terms on your behalf. You are responsible for your account and for everything done with it. Please keep one account per person.

3. Your photos and content

• You keep the rights to the photos you upload and to the images you create.
• You give us permission to store, process and send your photos to our AI providers, only to create your images and run the app (see the Privacy Policy).
• You confirm that you have the right to use every photo you upload, and that anyone else in the photo has agreed to it.
• The ideas and notes you write in Create (Write, Remix) are text only - never your photos or images. You give us a free, worldwide permission to use that text to run and improve the app: for example to suggest it, in edited form, as a new style or example for everyone, and to show it on an idea link when you choose to share one (anyone with that link can read the idea). Don't include personal details in it.

4. Things you must not do

• Upload photos of other people without their permission, or any photo of a child other than your own child.
• Create or share sexual, violent, hateful, harassing or illegal content, or anything that sexualises minors.
• Use created images to impersonate someone, spread false information, commit fraud, or pass off an AI image as a real photo in order to deceive.
• Infringe anyone's copyright, trademark, privacy or other rights.
• Create multiple or fake accounts, use bots or scripts, click or watch ads fraudulently, or otherwise abuse credits, referrals, rewards or leaderboards.
• Reverse-engineer, disrupt or overload the app or our servers, or try to get around its limits.

We may remove content, reverse credits gained through abuse, or suspend or delete accounts that break these rules.

5. AI-generated images

Images are created automatically by AI and may be inaccurate, unexpected, or not look like you. We don't guarantee any particular result. Credits spent on a generation that fails are returned automatically; a completed generation you don't like is not refunded. Images may carry a small "Picoza AI" watermark. If an image is inappropriate, please use "Report this image" in the app.

6. Credits and purchases

• Creating images uses credits. You can earn free credits (for example the sign-up bonus, daily check-ins, rewarded ads, spins, gift boxes and referrals) or buy credit packs.
• Credits are a limited licence to use features of the app. They have no cash value, can't be exchanged for money, sold or transferred to another account, and end when your account is deleted.
• Purchases are processed by Apple or Google. Refund requests are handled by them under their policies. If a purchase is refunded or charged back, the credits from it are removed, even if this makes your balance negative. A negative balance must be earned or bought back before you can create more images.
• We may change how many credits things cost or earn, and add, change or end free-credit features, at any time. This does not affect credits you have already bought.
• Referral rewards are paid only for genuine new users once they have created a few images (the number is shown in the app). Daily and per-network limits apply.

7. Top Creators

The Top Creators list in the app ranks users by how many images they created in the current month or week. It is just a ranking - there are no prizes, and it is not a contest. Apple and Google are not involved in it in any way.

8. Ads and other services

The app shows ads and links to services we don't run (for example Google or Apple sign-in, social media pages and app stores). We aren't responsible for their content or practices. Their own terms apply when you use them.

9. Our app

The app, its design, styles, templates, logos and software belong to us or our licensors. We give you a personal, non-transferable licence to use the app for your own non-commercial purposes under these Terms.

10. Ending your use

You can stop using the app, and delete your account in the app, at any time. We may suspend or end your access if you break these Terms, if the law requires it, or if we stop offering the app. When your account ends, your credits and images end too.

11. Disclaimers

The app is provided "as is" and "as available". To the extent the law allows, we make no promises that it will always be available, error-free or suitable for any particular purpose.

12. Limitation of liability

To the extent the law allows, we are not liable for any indirect, incidental or consequential loss, or for loss of data, profits or goodwill. Our total liability to you for any claim is limited to the amount you paid us in the 12 months before the claim, or INR 1,000 if that is higher. Nothing in these Terms limits any right you have that cannot be limited by law.

13. Indemnity

If you break these Terms or the law, or upload content you had no right to use, you agree to cover the losses and reasonable costs this causes us.

14. Changes to these Terms

We may update these Terms. We will change the date at the top, and tell you in the app about important changes. If you keep using the app after a change, the new Terms apply.

15. Law and disputes

These Terms are governed by the laws of India. Courts in Rajkot, Gujarat have exclusive jurisdiction, except where the consumer protection laws of your country give you the right to bring a claim where you live. Please contact us first; most problems can be solved quickly by email.
